On March 1, 2006, the Civil Trial Reform initiated by Law Decree No. 35 of March 14, 2005 (converted with amendments by Law No. 80 of May 14, 2005) finally came into effect.
Prominent among the new features are new rules for case handling and evidentiary instruction.
Given the importance of the novelty, the volume analyzes in detail the new procedural rules by comparing them with the former ones in order to grasp their differences.
Thus, the work traces the procedural stages: introduction of the case and constitution of the parties (with the novelties contained in Articles 163 bis and 167 c.p.c.), handling of the case and attempt at conciliation (new Articles 183 and 185 c.p.c.), evidentiary instruction (new Article 184 c.p.c.).
The overview is completed with an analysis of the Reform provided by Legislative Decree 5/03 for the corporate rite, the constitution and instruction in the judgment before the justice of the peace, in the labor judgment, in the Appellate and Cassation courts.
The entire volume makes extensive reference to case law and doctrine as well as a form and synoptic table; very useful for reference.
A very useful Formulary and a CD Rom containing case law and customizable formulas conclude the book.
