This work is now in its second edition due to the numerous legislative reforms of civil procedure and other legal areas covered in the text that have taken place from 2005 to the present.<\/p>\n

Numerous rulings by the Supreme Court and lower courts, as well as by the Constitutional Court, have gradually clarified and confirmed the scope of application and the effects of the new legislation on interim and emergency proceedings.<\/p>\n

The first two chapters (\u201cEmergency Protective Measures\u201d and \u201cProcedural Process\u201d) have been revised in accordance with the very recent reform of the Code of Civil Procedure enacted by Law No. 69 of June 18, 2009.<\/p>\n

The fourteen sections of Chapter 3 have been updated and revised to reflect not only the new provisions on civil procedure and electronic litigation but also the following legislative changes:<\/p>\n

-The first section has been revised in light of the repeal of the corporate proceedings introduced by Legislative Decree No. 5 of 2002;<\/p>\n

-The second section on industrial property law has been updated to include the provisions of the new Industrial Property Code, Legislative Decree No. 30 of February 10, 2005, and the relevant case law;<\/p>\n

-The third section on copyright has been amended pursuant to Legislative Decree No. 118\/2006, implementing Directive 2001\/84\/EC concerning the author\u2019s right to a royalty on subsequent sales of the original work of art, and Legislative Decree No. 140\/2006, which implements Directive 2004\/48\/EC on the enforcement of intellectual property rights; through these decrees, the legislature has established a structured and generally comprehensive framework governing the forms of copyright protection;<\/p>\n

-The eighth section on banking matters has been revised in light of the new Code of Ethics and Good Conduct for Information Systems Managed by Private Entities regarding consumer credit, creditworthiness, and timely payments (which took effect on January 1, 2005) and the decree of the Interministerial Committee for Credit and Savings dated September 22, 2008, which provided for the elimination of the centralized database for the reporting of low-value risks;<\/p>\n

-Section 10 on the right to health has been supplemented with the provisions of Legislative Decree 219\/2006, which implements certain EU directives regarding a Community code on medicinal products for human use, confirming the foregoing, which granted AIFA (the Italian Medicines Agency\u2014a public-law body operating under the guidance and supervision of the Ministry of Health), the power to prohibit the sale and use of a medicinal product and to order its withdrawal from the market\u2014even if limited to individual lots\u2014if, among other things, the medicinal product has quality defects that are potentially hazardous to public health.<\/p>\n

The final chapter, which reflects the changes already introduced by Law 80\/2005, has been supplemented with case law from the trial courts and the Court of Cassation dating from 2005 through 2009.<\/p>\n

From the foregoing, it is clear that not only was an update of the volume based on developments in case law unavoidable, but also an expansion of the volume itself, as it had also become necessary to add an entire chapter dedicated to the new summary trial procedure\u2014introduced by Law No. 69 of 2009 \u2014 as well as to other comparative aspects between the new procedure and the precautionary and emergency proceedings under Article 700 of the Code of Civil Procedure.<\/p>\n
